Chapter 420

AN ACT to provide for the construction by the State of a state highway in Essex county leading from Wilmington to the top of Whiteface mountain, and making an appropriation therefor

Became a law April 9, 1929, with the approval of the Governor. passed, by a two-thirds vote

The People of the State of New York, represented in Senate and Assembly, do enact as follows:

Section 1. A state highway in Essex county, leading from Wilmington to the top of Whiteface Mountain, shall be constructed upon lands of the state and shall be owned by the state, Such highway is to be constructed in commemoration of the services and sacrifice of the veterans in the world war from the state of New York and shall be known as the New York world war veterans memorial highway.

Section 2. For the purpose hereinafter stated, a temporary state commission, to be know as the Whiteface mountain highway commission, is hereby created, to consist of three commissioners to be appointed by the governor, one for a term of three years, one for a term of four years, and one for a term of five years. At the expiration of their respective terms of office, appointments shall be made for five years respectively, subject to the termination of the commission when the special purpose for which it is created shall have been accomplished. A vacancy occurring in any such office shall be filled by the governor by appointment for the unexpired term. Such commission shall choose from its members a chairman. Such commission shall be a body politic and corporate. With power to sue and be sued and to contract debts, but no debt contracted by it and no contract obligation incurred by it shall be an obligation of the state of New York. The members of the commission shall each receive as compensation for their services the sum of ten dollars a day for each day’s service performed prior to the completion and acceptance of such highway and in addition all necessary expenses of their duties, and employ needed assistants and fix their compensation, all such compensation and expenses to be paid from the funds od the said Whiteface mountain commission.

 

Section 7. The money needed for such work, above the amount appropriated by this act, shall be furnished to the state by the commission, and may be either contributed by the commission or its members or raised on its own obligations secured by the pledge of its revenues and tolls arising out of the use of such highway. Not more than twenty-five thousand dollars of the money appropriated by this act shall be available, until the commission shall have provided and deposited with the Comptroller at least twenty-five per centum of the difference between the amount appropriated and the amount needed for such work according to such estimates, together with the governor’s certificate provided for in section five. A copy of such estimates shall be filed with the superintendent of public works, and he shall certify the amount of such estimates to the comptroller. The comptroller shall be the custodian of such money and shall deposit the same in a bank or banks in which he is authorized by law to deposit state moneys. He shall pay out such moneys on the requisition of the chairman of such commission, and may make advancements, as needed. Vouchers therefor shall be subject to the comptroller’s audit.

Section 8. The sum of one hundred and fifty thousand dollars (1$180,000), is barely appropriated toward the construction of such highway, and for carrying out the provisions of this act. Subject to the provisions of this act, the moneys hereby appropriated shall be paid out of the state treasury, on the audit and warrant of the comptroller, on vouchers approved by the Chairman of the Whiteface mountain highway omission created by this act.

Section 9. This act shall take effect immediately.
